1. Preamble and definitions

Essens Sàrl (hereinafter the “Publisher”), a company specialized in Human Resources consulting, provides e-learning modules dedicated to the prevention of psychosocial risks (PSR) via an online platform (hereinafter the “Platform”) hosted in Switzerland.

Key definitions:

  • User: any natural or legal person accessing, registering for, or following the module.

  • Learning Content: texts, videos, quizzes, assessments, downloadable materials and related resources provided by the Publisher.

  • Intellectual Property: copyrights, related rights, patents, trademarks and other rights relating to the Content and the Platform.

  • User Account: personal login and password enabling access to the Platform.

  • Personal Data: any information relating to an identified or identifiable person.

2. Acceptance and contract

  • By using the module, the User accepts these ToU in force at the time of access.
  • The Publisher reserves the right to amend the ToU. Changes take effect upon publication on the Platform and, where applicable, after reasonable notice.

4. Access and registration

  • Registration conditions: the User must be of legal age or have appropriate legal consent and provide accurate, up-to-date information during registration.
  • Account and security: the User is responsible for the confidentiality of credentials and for activities under their account. The Publisher must be informed immediately in case of compromise.
  • Access restrictions: access is strictly personal and non-transferable without the Publisher’s written consent. Any unauthorized use may lead to suspension or termination of the account.

5. Intellectual property

  • Protected content: the Learning Content is protected by intellectual property laws. Any reproduction, distribution, commercial exploitation, modification or creation of derivative works is prohibited without written authorization.
  • Limited licence: the User receives a non-exclusive, non-transferable licence limited to accessing and using the Content for personal and internal training purposes, for the subscribed term.
  • Prohibition of unauthorized copies: any copying, off-platform downloading or public dissemination is prohibited without written authorization.
  • Trademarks and logos: use is prohibited without consent.

6. Security and anti-fraud

  • Technical measures: TLS for communications, password hashing, logging, detection of abnormal access, and anti-fraud measures (login attempt limitations, integrity checks).
  • Impersonation and circumvention: any attempt at unauthorized access, hacking or illegal copying is prohibited and may give rise to civil and criminal action.
  • Content protection: possible DRM/watermarking; circumvention prohibited.
  • Detection and response: the Publisher may monitor access and suspend accounts in case of suspicious behaviour.

7. Personal data and confidentiality (FADP and GDPR where applicable)

  • Purposes: managing registrations, access, learning progress and communications.
  • Legal bases: performance of the contract, consent where necessary, legal obligations and legitimate interests (fraud prevention, security).
  • Hosting: data stored exclusively in Switzerland.
  • Data subject rights: access, rectification, deletion, restriction, objection, portability (pursuant to the FADP and, where applicable, the GDPR).
  • Retention: for the necessary period or as required by law.
  • Security: appropriate technical and organizational measures to protect data.

8. Cookies and cookie policy — 8.1 Definition and scope

The Platform may use cookies and similar technologies (e.g., pixels, session traces) to ensure operation, analytics and improvement of the user experience.

Cookies used:

  • Essential cookies: ensure technical operation (login, security, session preferences).

  • Performance and analytics cookies: collect anonymized information on use of the site and content to improve the service.

  • Functional cookies: remember preferences (language, settings) for a personalized experience.

The User is invited to give consent for non-essential cookies on the first visit.
The User can manage cookie preferences via browser settings or a dedicated banner/panel on the Platform.

Duration and security:

  • Retention period of cookies: depending on type, generally up to 13 months for non-essential cookies unless consent is renewed.

  • Security: cookies must not allow access to sensitive data without authorization.

9. Learning analytics and assessments

  • Tracking and scoring: results, certificates or attestations depending on the offer. Information is stored on the Platform and accessible to the User and authorized administrators.
  • Accuracy: corrections are possible in case of proven errors.

10. Warranties, liability and indemnification

  • Warranty: service provided “as is”; reasonable availability and security but no uninterrupted guarantee.
  • Limitation of liability: capped at the amount paid for access during the current period, except in the event of intentional misconduct or fraud.
  • Associated responsibilities: performance of the User’s obligations and respect for intellectual property rights.

11. Suspension, termination and sanctions

  • Suspension: breach of the ToU may result in suspension or termination without prior notice or refund.
  • Modification: the Publisher may modify or discontinue the service; reasonable information will be provided where feasible.
  • Termination: modalities and notice where applicable.

12. Protection of minors

  • If accessible by minors, controls and consents required by law will be applied.

13. Advertising and external links

  • The service may contain links to third-party sites; the Publisher is not responsible for the content or security of such sites.

14. Governing law and disputes

  • Governing law: Swiss law.
  • Jurisdiction: courts at the Publisher’s registered office, subject to mandatory provisions.
  • Language: the French text prevails in case of discrepancy.

15. Miscellaneous

  • Partial validity: if any clause is invalid, the remaining provisions remain in force.
